Meet in the Middle.
Meet in the Middle.
“The courts of this country should not be the places where resolution of disputes begins. They should be the places where the disputes end after alternative methods of resolving disputes have been considered and tried.”
-- Former U.S. Supreme Court Justice Sandra Day O'Connor
Mediation – the process where the parties meet with a mutually selected impartial and neutral person who assists them in the negotiation of their differences – is such an effective form of alternative dispute resolution, state and federal courts mandate its application before many types of lawsuits may proceed to trial. And for good reason. Mediation has numerous benefits:
Mediation helps to reduce conflict between parties by facilitating communication and promoting understanding thus minimizing future conflict.
“I don’t like that man. I’m going to have to get to know him better.” — Abraham Lincoln
Mediation resolves disputes efficiently and effectively. Mediation is almost always a more cost-effective alternative than going to trial.
“An ounce of mediation is worth a pound of arbitration and a ton of litigation!”
— Joseph Grynbaum
Mediation typically resolves disputes in hours or days and certainly much faster than the months or years often endured before a civil action is called for trial.
“There is nothing to be learned from the second kick of a mule.” — Mark Twain
In mediation, the parties have control over the outcome, unlike in court, where the final decision is made by a judge or jury.
“In the middle of every difficulty lies opportunity.” — Albert Einstein
Mediation is confidential and private, whereas court proceedings are public. Mediation is the optimum way for the parties to maintain privacy and avoid a public spectacle.
“Remember not only to say the right thing in the right place, but far more difficult still, to leave unsaid the wrong thing at the tempting moment.” — Benjamin Franklin
Mediation can help preserve relationships between parties since any resolution must be agreed upon completely by both sides.
“You can't shake hands with a closed fist.” — Indira Gandhi
Mediation can result in a personalized solution that is specific to the needs of the parties which may extend beyond what a court is lawfully authorized to impose. Precise and creative solutions are much more possible in a mediated settlement.
